These terms of service ("terms") govern your access to and use of pixelspyer.com, the PixelSpyer app, API, browser-based tools and related services (together, the "service"), provided by PixelSpyer ("PixelSpyer", "we", "us"). By creating an account or using the service, you agree to these terms. If you use PixelSpyer on behalf of a company, you confirm that you can bind that company to these terms, and "you" includes the company.

1. Who can use PixelSpyer

You must be at least 18, or the age of majority where you live, to create an account. PixelSpyer is designed for business and professional use, such as marketing research. You may not use the service if you are barred from doing so under applicable law.

2. Your account

  • Give accurate information when you sign up and keep it up to date.
  • Keep your password and API keys secure. You are responsible for activity under your account.
  • Each account is for one person. Do not share logins; use shared boards to collaborate.
  • Tell us promptly at [email protected] if you suspect unauthorised access.

3. Plans, billing and renewals

  • Plans. We offer a free plan and paid plans with the features and limits described on our pricing page. Limits such as daily searches, saved ads and AI generations apply per account and reset on the schedule shown in the app.
  • Payment. Paid plans are billed in advance, monthly or yearly, through our payment providers (Stripe, PayPal or Razorpay). You authorise us and our providers to charge your chosen payment method.
  • Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. You can cancel at any time in billing settings.
  • Taxes. Prices may exclude taxes such as VAT or GST, which we add where required.
  • Changes in price. If we change the price of your plan, we will tell you in advance, and the new price applies from your next renewal. You can cancel before then.
  • Upgrades and downgrades. Upgrades take effect immediately. Downgrades take effect at the end of the current period; content that exceeds the new plan's limits may become read-only or paused rather than deleted.
  • Failed payments. If a payment fails, we may retry it and may downgrade or suspend paid features until it succeeds.
  • Codes and promotions. Redeem codes and promotional offers are subject to the terms shown when they are issued, cannot be exchanged for cash and may expire.

4. Cancellations and refunds

You can cancel at any time and keep access until the end of the period you have paid for. Refunds are handled under our refund policy, which includes a 7-day money-back guarantee on the first payment of a plan. Nothing in these terms limits any refund rights you have under mandatory consumer law.

5. Acceptable use

You agree not to:

  • Scrape, crawl or bulk-download the service, or extract data beyond the exports and API access your plan includes.
  • Resell, sublicense, publish or redistribute PixelSpyer data or access as a competing database or service.
  • Circumvent plan limits, rate limits, paywalls or security measures, or create multiple accounts to do so.
  • Reverse engineer or interfere with the service, except where the law expressly allows it.
  • Use the service to infringe intellectual property, to copy or impersonate advertisers' creatives, trademarks or brands, or to mislead consumers.
  • Use the service to harass, stalk or target any person, or to process personal data unlawfully.
  • Upload malware or content that is unlawful, defamatory or infringing.
  • Use the service in breach of applicable law, including advertising, consumer protection and data protection law.

We may investigate suspected breaches and take proportionate action, including limiting, suspending or closing accounts.

6. Ad data

  • Source. The ads in PixelSpyer come from the public Meta Ad Library. PixelSpyer is an independent product and is not affiliated with, endorsed by or sponsored by Meta.
  • Ownership. Ads, creatives, copy, brand names and trademarks belong to their respective owners. We give you access to this public information for research, analysis and inspiration within your own business or for your clients. We do not grant you any rights in the ads themselves.
  • Your responsibility. You are responsible for how you use what you find. Do not reproduce other advertisers' creatives, copy or brand assets without their permission.
  • Accuracy. Ad data is provided as published by Meta and processed by us. It may be incomplete, delayed or inaccurate, and signals such as days running, reach estimates or country counts are indicators, not measures of performance or sales.
  • Removal. Advertisers and rights holders can ask us to review or remove ads through the contact form using the topic "Data removal request".

7. AI features

AI studio and other AI features generate text based on your inputs. Output may be inaccurate, incomplete or similar to content generated for others. You are responsible for reviewing output before you use it, including checking claims and making sure it does not infringe anyone's rights or break advertising rules. Do not input confidential information you are not allowed to share. As between you and us, you may use the output you generate for any lawful purpose.

8. Your content

You keep ownership of the content you create in PixelSpyer, such as board names, descriptions and notes ("your content"). You grant us a worldwide, non-exclusive licence to host, store and display your content only as needed to provide the service. If you make a board public, anyone with the link can view it until you make it private again.

9. Our intellectual property

The service, including its software, design, databases, enrichment, text and trademarks, belongs to PixelSpyer or its licensors and is protected by law. These terms give you a limited, non-exclusive, non-transferable, revocable right to use the service in line with your plan. Feedback you send us may be used without obligation to you.

10. API

If your plan includes API access, you may use it within the published rate limits and the API documentation. Keep keys secret, do not embed them in client-side code and rotate them if they are exposed. We may change, limit or revoke API access to protect the service.

11. Affiliate program

If you join the affiliate program, you earn 30% of payments made by customers you refer during their first 12 months, subject to a 60-day referral cookie window and the program rules on the affiliates page. Commissions are paid monthly via PayPal once your approved balance reaches $50. Refunded or charged-back payments earn no commission. Self-referrals, brand-term bidding, spam and misleading promotion are not allowed, and we may withhold commission and remove participants who break the rules.

12. Third-party services

The service relies on third parties, including payment providers, sign-in providers and the Meta Ad Library. Their terms and privacy policies apply to your use of their services. We are not responsible for third-party services or websites we link to.

13. Changes and availability

We continuously improve PixelSpyer and may add, change or remove features. We aim for high availability but do not guarantee the service will be uninterrupted or error-free, and we may carry out maintenance. If we make a change that materially reduces a paid feature you rely on, we will tell you in advance where reasonable.

14. Disclaimers

To the extent permitted by law, the service and all data are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. PixelSpyer does not guarantee any business result, such as sales, profit or advertising performance, from using the service.

15. Limitation of liability

To the extent permitted by law, PixelSpyer will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for all claims relating to the service in any 12-month period is limited to the amount you paid us for the service in that period, or USD 100 if greater. Nothing in these terms excludes liability that cannot be excluded by law, such as liability for fraud or for death or personal injury caused by negligence.

16. Indemnity

If you use the service for business purposes, you agree to defend and indemnify PixelSpyer against claims arising from your content, your breach of these terms or your misuse of the service, including your use of ad data or AI output.

17. Suspension and termination

You can stop using PixelSpyer and delete your account at any time in your settings. We may suspend or terminate your access if you materially breach these terms, if required by law, or to protect the service or other users. Where reasonable, we will give notice and a chance to fix the problem first. Sections that by their nature should survive termination, including those on ad data, intellectual property, disclaimers and liability, will survive.

18. Governing law and disputes

These terms are governed by the laws of the country in which PixelSpyer is established, without regard to conflict-of-law rules, and the courts of that country have jurisdiction. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live and may bring proceedings there. Before starting any formal dispute, please contact us so we can try to resolve it informally.

19. Changes to these terms

We may update these terms from time to time. We will post the updated version here with a new "Last updated" date and, for material changes, notify you by email or in the app before they take effect. Continuing to use the service after changes take effect means you accept them.
